This by-laws is specially prepared to assist you in the moving-in process and setting up your home in the condominium. Part 1 General

Interpretation- Subsidiary Proprietor in this By-Law means owner and both terms are interchangeable.

Particulars of Tenants and Lessees

The Owner of a lot which is tenanted out is to provide the full particulars of the tenant and the period of the tenancy of that lot within 14 days from the date of the commencement of the tenancy agreement.

Owner(s) who has tenanted out his lot will not be allowed to make use of all recreational facilities or to wash his cars within the estate.

Use of Common Property

A subsidiary proprietor or occupier of a lot shall not: -

Ride, use or leave in any corridor, stairway, lobby or lift his bicycles, tricycles, children's riding toys, roller skates, skateboards and the likes.

Be permitted to engage in any form of game in the common property..

Be permitted to wear any wet swimming attire, smoke, drink or consume food in the lifts.

Damage or remove any fittings or fixtures to the common property.

Alterations and Additions to Strata Lots

A subsidiary proprietor or occupier of a lot shall: -

Not install any immovable fixtures and fittings or carry out any alteration or addition to his lot, which may affect the structural stability of the building or cause an increase in insurance premium rates or the cancellation, invalidation or non-renewal of existing insurance policies.

Prior to the commencement of any alteration and addition works to his lot obtain the approval from the Management Corporation as regards the schedule and timing of the said works and pay a deposit of $500.00 to the Management Corporation S.T. 2036.

The deposit shall be used by the Management Corporation to make good any damage to the common property or remove debris in the event that the subsidiary proprietor or occupier of the lot fails to comply with the Management Corporation's request to do so. The Management Corporation shall refund the unutilized sum of the deposit to the subsidiary proprietor concerned after it has ascertained that no further remedial works need to be carried out.

Not to paint on the external additional grilles or window frames colors other than color coated (green) for the living and service balconies.

Household Removal or Renovation

A subsidiary proprietor or occupier of a lot shall: -

Give the Management Corporation at least twenty-four (24) hours notice of any household removal or renovation.

Ensure that all bulk waste or renovation debris are removed from the common property/Bin Center on completion of the removal or renovation and that the cleanliness of the affected common property shall be restored to its original condition prior to the removal or renovation. If this is not done, the Management Corporation may engage other contractors to do the work and cost will be charged to the respective resident or proprietor.

Pay a security deposit of $500.00 to the Management Corporation for usage of lifts for household removal, renovations, purchases of new furniture, etc.

The Management Corporation has the right to utilize the said sum to make good any damages to the lifts if the contractor or subsidiary proprietor fails to comply with its request.

All owner/occupier of a lot shall apply for and obtain written permission from the Management Corporation before carrying out any fitting out works to the lot including internal partitioning, renovations involving the building, structural, mechanical and/or electrical services. All applications shall be made on the prescribed forms.

Owner/occupier wishing to fit out his lot must obtain the approval of the Building Construction Authority (BCA) if required. If not required, the proprietor must show proof from the BCA or the Management Corporation's Architect that no approval is needed from the BCA.

Owner shall undertake that they shall be responsible for their contractors complying with the terms and conditions governing the fitting out works and other regulations in compliance with the building by-laws that may be introduced from time to time.

Fitting out works must be carried out within the owner's/occupier's premises and under no circumstances are works allowed to be carried out at common areas.

No structural part of the premises is to be tampered with in any circumstances.

The owner/occupier shall not make any alternation to the window installed in the external walls without obtaining prior approval from the Management Corporation.

Any alteration/modification of electrical circuit, upgrading of electricity supply must be carried out by approved contractors (licensed electrician) and testing approved by Singapore Power Supply. Approval is also to be obtained from the WE Engineer of the Management.

The working hours for fitting out works may only be allowed to be carried out on weekdays during the hours of 0900 hrs to 1700 hrs, No works are allowed on Saturdays, Sundays and Public Holidays. Major hacking works for the whole unit is strictly allowed for the first 5 days only.

Only vehicles below the height of 1.8m are allowed into the estate. Loading and unloading shall only be carried out at areas designated by the Management.

No storage space will be provided at site. All articles/materials must be stored within the owner's/tenant's premises.

Upon commencement and completion of the fitting out works, the owner/occupier shall notify the Management Office for a joint inspection to ensure that the site is in satisfactory condition.

The Management or its agent shall have the right to gain access into the premises to make spot checks and to issue instructions to ensure that the conditions contained herein are complied with.

The Management reserves the right to demolish the works carried out in contravention of any terms and conditions herein or the building by-laws and to recover from the owner/occupier all costs and expenses incurred in this connection.

The owner/occupier is required to take up all necessary insurance policies with adequate coverage during the fitting out period.

Security

A subsidiary proprietor or occupier of a lot shall: -

Comply with any lawful requests and direction given by the security personnel in connection with By-Laws.

Stop his vehicle at the entrance of the Serenity Park Condominium (referred herein as the Condominium) and when directed by the security personnel for security checks.

Take reasonable steps to ensure his guests, employees, independent contractors, licensees or any other person comply with the lawful requests and directions given by the security personnel in connection with By-Laws.

Register his residence contact number with the Security Guard House if he desires confirmation of his consent to permit entry of guests, employees, independent contractors, licensees or any other person after midnight, otherwise such entry would be denied.

Facility Cards

A subsidiary proprietor or occupier of a lot shall: -

Be permitted use of any of the recreational facilities upon the surrender without demand of valid resident cards to the security personnel.

Be entitled to apply for the resident cards. The number of cards to be issued shall be determined in accordance with the approved share value allotted to the strata lot. The issuance of additional cards shall be at the discretion of the Council.

Be liable to pay a fee of $5.00 or such sum as may be revised from time to time by the Council for replacement of any damaged or lost resident card. Resident cards are personal to the holders and are not transferable.

Have his -facility card revoked if he defaults in payment of contributions to the management and sinking funds. The subsidiary proprietor or occupier of a lot shall within seven (7) days of service of a notice in writing from the Management Corporation surrender the revoked cards. Holders of invalid or revoked cards shall be debarred from the use of the recreational facilities.

Use of Recreational Facilities by Subsidiary Proprietors or Occupiers of Lots

A subsidiary proprietor or occupier of a lot shall: -

Not be permitted to engage in any game or activity in or about the recreational facilities other than those for which the recreational facilities are designed.

Inform the security personnel or authorised representative of the Management Corporation of any damage to the facilities or equipment provided in such facilities. If no prior notice of any damage is given before the use of the facilities, he may be held responsible to make good the damage/s whether caused by himself, his family members or invitees.

Not conduct himself in such a manner in the use of any of the recreational facilities other than for the intended purpose so as to cause nuisance or annoyance to other users. A subsidiary proprietor or occupier of a lot who misconduct or persists to misconduct himself to the annoyance of other users may be debarred from the use of the recreational facilities for such period of time as the Council may deem fit. The owner will have to make good any damages caused by him or his guests.

Use of Recreational Facilities by Guests

A subsidiary proprietor or occupier of a lot shall: -

Be entitled to apply for visitor facility cards to enable his visitors to enjoy the use of the recreational facilities. Such cards are issueable at the discretion of the Management Corporation and renewable on a weekly basis or at such periodic intervals as the Management Corporation may decide.

Be liable to pay a fee of $5.00 or such sum as may be revised from time to time by the Management Corporation for replacement of any damaged or lost visitor facility card.

Ensure that his visitors observed the By-Laws governing the use and enjoyment of the recreational facilities.

Accompany his visitors at all times when they are using the recreational facilities.

Be barred from applying for any visitor facility cards for a period of one (1) year if any of his visitors is in breach of the By-Laws in force from time to time.

Perimeter Fence/Wall- Owner(s) or occupier(s) or invitee(s) will not be allowed to climb over the Perimeter Fence or Wall of the estate to gain entry into the estate.

Sanctions for Non-Compliance

In the event of a breach of these By-Laws, a subsidiary proprietor or occupier of a lot may have his facility cards and/or car parking label revoked or suspended until such time as the said breach is remedied.

Responsibilities of Management Corporation, Council and Managing Agent

The Management Corporation, Council and Managing Agent shall not be liable or responsible to any subsidiary proprietor or occupier of a lot or any of their family members, guests, employees, independent contractors, invitees, licensees or to any other person, for any loss of life, personal injury or damage to property arising from or out of any occurrence in, upon or at the Condominium or the use of the recreational facilities.

Statutory By-Laws

Nothing herein shall be construed as intended to add to, amend or repeal any Statutory By-Laws in force from time to time by the Land Titles (Strata) Act (Chapter 158) or any amending, replacement or modifying legislation relating thereto and in the event of any inadvertent or unforeseen inconsistency, the Statutory By-Laws shall prevail.

 

Part 2 Use of Swimming Pool/Spa Pool

Operating Hours

A subsidiary proprietor or occupier of a lot shall be permitted to use the swimming pool from 7.00 a.m. to 10.00 p.m. daily unless the Management Corporation changes the operating hours or closes the pool for repairs and maintenance or any other reason as it may deem necessary.

Entry of Pool

A subsidiary proprietor or occupier of a lot shall: -

Produce for inspection his facility card to any security personnel.

Accompany his guests and/or invitees during their use of the pool and shall take, all reasonable steps to, ensure that they abide by the relevant By-Laws.

Be permitted a maximum of two guests or invitees at any one time unless otherwise approved by the Council. Such guests or invitees shall be required to book in before entering the pool.

Use of Pool

A subsidiary proprietor or occupier of a lot shall: -

Wear proper swimming costume/trunk and take a shower before entering the pool.

Not consume any refreshment and drinks or smoke in the pool and the immediate vicinity.

Not bring any pets into the pool area.

Not use the life buoys except for emergency situations.

Not to wear any hairpins, curlers, safety pins, hobby pins and other likes objects in the pool.

Not wear shoes or other footwear on the decks of the pool.

Not use surfboards, scuba diving gear, frisbee and balls except inflatable toy balls in the pool.

Not use the pool if he is having infectious diseases or open wounds.

Not spit, blow his nose, urinate, dirty or foul the pool water and its surrounding areas.

Not create a nuisance or annoyance to other users by jumping or diving from the side of the pool or engage in rough or dangerous play in the pool.

Not do or cause to be done or omit to do anything, which may interfere with any other person's use and enjoyment of the pool.

Leave the pool in the event of a thunderstorm.

Not cycle, roller-skate or play ball games within the pool compound.

Required to dry themselves before leaving the pool area and changing room.

No removal of pool side furniture.

Duties & Responsibilities of Users

A subsidiary proprietor or occupier of a lot shall: -

Be responsible for the safety of themselves, family members, guests, employees, invitees or any other person using the pool.

Not hold the Management Corporation and its agent liable or in any way responsible to their respective family members, guests, employees, independent contractors, invitees, licensees or any other person, for loss of life, personal injury or damage to property arising from or out of any occurrence in, upon or at the pool or the use of the pool howsoever arising, whether or not such use was authorized by these Supplementary bylaws or otherwise.

Be responsible for ensuring that the swimming pool is not entered or used by any child under their charge or guardianship, below the age of 12 years unless accompanied by an adult who shall be responsible for the supervision of such child.

 

Part 2 Use of Spa Pool

Operating Hours

The spa pool shall be opened for use from 7.00 am to 10.00 pm. unless the Management Corporation changes the operating hours or closes the spa pool for repairs and maintenance or any other reason as it may deem necessary.

However, the spa equipment will be operated on a manually operated switch that permits the spa to run automatically but on a 1/2 hour duration interval.

Entry of Pool

The use of the spa pool is only restricted to residents of Serenity Park. , No invited guest is allowed unless accompanied by a subsidiary proprietor or occupier.

User of Pool

Users are advised to shower before entering the spa pool. A person with a bandage or open wound infections or communicable disease shall not be allowed to use the spa pool. Spitting, spouting, nose blowing and the like shall not be permitted in the spa pool.

All persons are required to dry themselves before leaving the spa pool area.

Users under twelve (12) years of age are NOT allowed in the spa pool unless accompanied by their parents or supervising adults who shall be responsible for the users' safety and behaviour.

No food and beverages shall be permitted in the spa pool or the vicinity.

Smoking is strictly not permitted.

No pets shall be allowed in the spa pool or the vicinity.

Noisy, rough or dangerous play will not be permitted in the spa pool.

The security guards or any representatives of the Management Corporation may require any person in the spa pool to identify himself or herself.

 

Part 3 Use of Tennis Courts

Operating Hours

A subsidiary proprietor or occupier of a lot shall be permitted to use the tennis court from 9.00 a.m. to 10.00 p.m. daily unless the Management Corporation changes the operating hours or closes the courts for repairs and maintenance or any other reason as it may deem necessary.

Reservation of Courts

A subsidiary proprietor or occupier of a lot shall: -

Be permitted to make reservation of the court in person on first-come-first-served basis at the Security Guard House between 9.00 a.m. and 10.00 p.m. daily.

Produce for inspection his resident card for all reservations.

Not to make reservation or booking through the telephone.

Be entitled to reserve in advance a maximum of two (2) hours of the use of the court per calendar week in either one period of two (2) consecutive hours or two periods of one (1) hour each. 'Calendar week' shall mean the week beginning on Monday and ending on Sunday.

No pets shall be allowed in the tennis courts.

Be permitted to make reservation of the court by booking it not earlier than seven (7) days in advance.

Not be permitted to reserve two (2) tennis courts in the same session.

No food/smoking are permitted in the courts.

Be responsible for the general cleanliness of the courts.

Be responsible for any mishaps arising from the use of the courts.

Entry of Courts

A subsidiary proprietor or occupier of a lot shall:-

Not enter the court unless a reservation has been made for Abe period.

Be deemed to have cancelled his reservation if he fails to turn up within fifteen (15) minutes from the time his booking commences in which event the court will be allocated to other users.

Show his resident card on demand to any security personnel employed by the Management Corporation.

Be present at the court during the period booked as otherwise the booking would be deemed as invalid and players may be prevented from using the court.

Not allow children under twelve (12) years of age into the tennis courts unless accompanied by adults who shall be responsible for their supervision and safety.

Proper Attire

A subsidiary proprietor or occupier of a lot shall be properly attired in shorts, T-shirts and non-marking tennis shoes when using the court.

 

Part 4 Use of Gymnasium

Operating Hours

A subsidiary proprietor or occupier of a lot shall be permitted to use the gymnasium from 7.00 a.m. to 10.00 p.m. daily unless the Management Corporation changes the operating hours or closes the gymnasium for repairs and maintenance or any other reason as it may deem necessary.

Entry of Gymnasium

A subsidiary proprietor or occupier of a lot shall: -

Produce for inspection his resident card to the security personnel at the Security Guard House.

Not be permitted to bring guests and invitees to use the gymnasium under any circumstances.

Not be permitted to bring children under the age of 12 years to use the gymnasium under any circumstances.

Ensure that children between the ages of 12 and 16 years are accompanied and supervised by an adult in the gymnasium under any circumstances.

Use of Gymnasium

A subsidiary proprietor or occupier of a lot shall: -

Exercise due care when using the equipment in the gymnasium.

Not mishandle or misuse any equipment or weights in the gymnasium.

Return the equipment to their proper places after use.

Not remove the equipment out of or from the gymnasium.

Not consume any refreshment and drinks~ or smoke in the gymnasium.

No pets shall be allowed in the gymnasium.

Proper Attire

A subsidiary proprietor or occupier of a lot shall be properly attired in shorts and T-shirts or leotards or track suits and sports shoes in the gymnasium.

A subsidiary proprietor or occupier of a lot shall not be permitted to use the gymnasium in wet bathing suits.

 

Part 5 Use of Function Room

Operating Hours

A subsidiary proprietor or occupier of a lot shall be permitted to use the function room over any session as follow:

Session 1: From 9.00 a.m. to 5.00 p.m or
Session 2: From 5.00 p.m. to 12.30 a.m.

unless the Management Corporation changes the operating hours or closes the room for repairs and maintenance or any other reason as it may deem necessary.

Reservation of Room

A subsidiary proprietor or occupier of a lot shall: -

Be permitted to make reservation of the room in person on first-come-first-served basis at the Management Office during office hours and at least one month in advance upon payment of a refundable security deposit of $100.00 in advance to MCST No 2036.

Produce for inspection his resident card for all reservations.

Be allowed to book the function room up to a maximum of 02 sessions on Monday to Friday and a maximum of 01 session on Saturday, Sunday and Public Holiday per calendar month.

Use of the Room

A subsidiary proprietor or occupier of a lot shall: -

Ensure that the function room is used for social gathering including those usages as originally intended and/or approved thereat.

No cooking is allowed in the function room and all users of the function room are to use disposable utensils.

Be responsible for the cost of repairs on any damages arising from the use of the room.

Be barred from making any further bookings if he does not pay for the damage.

No live band music or mobile disco is allowed when using the function room except only for portable components approved by the Management.

Ensure that noise by his guests, invitees and any other person be kept at minimum and to ensure their good conduct and behavior.

Ensure that the number of persons who may use the room shall not exceed twenty (20).

Dispose all litter/waste food into the trash bags.

Be responsible to ensure that no gambling, illegal or immoral activities when using the function room.

The security deposit will only be refunded upon satisfaction by the Management that all rules and regulations have been complied with and all debris removed after use.

Allow access to the Management and/or its servants or agents to check on the activities during the function period and to halt any activities as and when directed by the Management.

Cancellation of function room booking has to be cancelled 3 days in advance via portal service or through the Management Office. Failure to do so would result in a ban of weekend booking of the function room for 2 months.

 

Part 6 Use of Barbeque Pits

Operating Hours

A subsidiary proprietor or occupier of a lot shall be permitted to use the barbeque pits from 11.00 a.m. to 11.00 p.m. daily unless the Management Corporation changes the operating hours or closes the pits for repairs and maintenance or any other reasons as it may deem necessary.

Reservation of Pits

A subsidiary proprietor or occupier of a lot shall: -

Be permitted to make reservation in person of the pit on first-come-first-served basis at the Management Office during office hours.

To collect an administrative fee of $10.00 per usage for the barbeque pit. Payment must be made one week in advance and no cancellation or refund of administrative fees is allowed once the payment is made.

Not to make reservation or booking through the telephone.

Be entitled to reserve one (1) pit for one (1) session subject to a maximum of two (2) reservations per calendar month.

Be permitted to make a reservation of the pit by booking it not earlier than one (1) month in advance.

Use of the Pit

A subsidiary proprietor or occupier of a lot shall: -

Check the pit before using and report any damage to the security personnel employed by the Management Corporation.

Produce for inspection his resident card to the security personnel at the Security Guard House.

Clean the pit, benches and adjacent vicinity after use.

Completely extinguish any burning coal and ensure they are cold before discarding them info the litterbins.

Place all leftovers in the litterbins.

Not wash any utensil at/near the barbeque pits or swimming pool compound or toilets.

Be responsible for any mishaps arising from the use of the pits.

No live band or mobile disco is allowed when using the barbeque pits except only for portable components approved by the Management and to ensure that the volume is maintained at a reasonable level.

Take all reasonable steps to ensure guests or invitees using the pits do not cause inconvenience, nuisance or annoyance to other persons or swimmers

 

Part 7 Use of Saunas

Operating Hours

The saunas will be opened from 7.00 am to 10.00 pm daily-unless the Management Corporation changes the operating hours or closes the saunas for repairs and maintenance or any other reason as it may deem necessary.

Entry of Sauna

The sauna is opened only to residents and their invited guests.

Use of Sauna

Persons using the saunas must be property attired and be in good behaviour.

Users are advised to shower before entering the saunas.

The door of the saunas must be closed at all times but not locked.

A person who breaches any of the rules shall be required to leave the saunas.

No male person shall enter the sauna reserved for the female sex and vice-versa.

Eating, drinking and smoking in the saunas are strictly prohibited.

Persons using the saunas must observe health warning signs posted at the entrance to the saunas.

An adult must accompany children using the saunas.

The Management shall not be responsible for any mishap arising from the use of the saunas.

The Management reserves the right to change any rules and regulations without prior notice.

 

Part 8 Use of Car Parks

Use of Car Parking Lots

A subsidiary proprietor or occupier of a lot shall: -

Apply for and collect at the Management Office car-parking label issued by the Management Corporation. Each unit is entitled to a parking lot at the Basement Car Park.

Not be issued with the car parking label if he is in arrears of maintenance contributions or other charges that are due to the Management Corporation or if he is in breach of any of the By-Laws in force from time to time.

Display the Management Corporation's car parking label on the car windscreen.

Be permitted to park his vehicle in any lot at basement carpark if he displays a valid car-parking label entitling him to the use of the lots.

Be permitted to park his vehicle only at lots designated for visitors at open space carpark if he displays a valid visitor-parking pass.

Take all responsible steps to ensure that his visitors, guests or invitees park their cars in the parking lots marked for visitors only at open space carpark.

Not park his vehicle at emergency exits or any part of the common areas except in designated parking lots.

Have his car parking label revoked by the Management Corporation if after being issued with the label, he defaults in the payment of maintenance contributions or commit any breach of any of the Management Corporation's By-Laws.

Surrender any revoked car label to the Management Corporation within seven (7) days from the service of notice by the Management Corporation.

Not be permitted to drive his vehicle into the Condominium grounds by the security personnel at the Security Guard House if he fails to amend or continue to display such revoked label.

Immobilising or Blocking or Towing Away of Vehicles

The Management Corporation shall have the right to immobilise by clamping the wheels of any vehicle or tow away any vehicle if it is found not property parked or parked at areas not designated for parking or parked at lots which are designated only for vehicles with valid Management Corporation's car labels.

The Management Corporation shall have the right to levy a penalty on the owners or drivers of the damped vehicles, before releasing the clamps, at the following rates :-

$150 for the first offence
$200 for each subsequent offence.

Indemnity by Subsidiary Proprietor or Occupier of a Lot

A subsidiary proprietor or occupier of a lot shall indemnify and keep indemnified the Management Corporation and its agents from and against all claims, demands, writs, summonses, actions, suits, proceedings, judgements, orders, decrees, damages; cost, losses and expenses of any nature whatsoever which the Management Corporation and its agents may suffer or incur in connection with the exercise of its power to immobilise or tow away vehicles which belong to the subsidiary proprietor or occupier of the lot or his invitee.

 

Part 9 Control of Pets

Keeping of Livestock, Poultry and Other Non-Household Pets

A subsidiary proprietor or occupier shall not be permitted to keep livestock, poultry and other non-household pets.

Control of Pets

A subsidiary proprietor or occupier of a lot shall: -

Accompany and restrain his pet at all times when in the common areas.

Not bring his pet in or about the recreational facilities, changing rooms and Management Office.

Dispose off immediately his pet excreta.

Be responsible for all costs of :-

Cleaning and/or repairing of common areas littered, soiled or damaged by his pets.

Capturing and keeping in custody any pet which is found unaccompanied or unrestrained in the common areas.

Ensure that his pet does not :-

Defecate on the lawn, parking lots, lifts and other parts of the common property.

Destroy plants, shrubs and other common property.

Create noise or other nuisance to the annoyance of the subsidiary proprietors or occupiers of other lots.

 

Part 10 Installation of Aircond Units/Window Grilles

Installation of Air-conditioning Units

The Management Corporation before commencement of works must approve all methods of installations.

All condensing units must be fitted with drain pan/tray and a proper drainage discharge and supported with stainless steel brackets.

All condensing units for split unit air-conditioning system have to be placed within the premises proposed area.

Window units must be secured with stainless steel brackets with proper drainage discharge.

Installation of Window/Gate Grilles

The gate grille shall be fixed within the boundary of the unit and must not encroach on common area. No drilling on the floor tiles or the common area is allowed.

The window grilles or casement windows for the living, service and master bedroom balconies must be fabricated in color coated (green) aluminum.
